These Terms of Service establish the conditions for access to and use of the website https://ficaeditions.com (hereinafter referred to as the "website" or "service") and any commercial transaction carried out through it, which the user and customer undertakes to comply with.

The website https://ficaeditions.com is the property of Fica Oficina Criativa, Unipessoal Lda (hereinafter referred to as "Fica"), with Portuguese VAT (NIF) number 514096624, registered office at Rua de Arroios 154B, 1150-056 Lisboa, legitimate owner of the Fica trademark.

Our online store is hosted by Shopify Inc., which provides the online e-commerce platform that enables us to sell our products and services to you.

Viewing or carrying out any commercial transaction through the website constitutes acceptance of these terms and conditions.

Fica has the right to change at any time these Terms of Service without prior notice, the user and customer is responsible for consulting and reading them periodically, as the conditions in force will apply at all times.

Customer and user obligations

The user and client of the website must comply with and respect the these terms and conditions and guarantees certain obligations for the proper operation of the website, such as:

- Use this website only for legally valid inquiries and requests;
- Any defamatory, obscene, xenophobic and/or other content that violates current legislation, general principles of law and public order is prohibited;
- Never make false or fraudulent requests;
- To grant the personal data strictly necessary for the processing of your orders and requests;
- Alert you to any changes that compromise the processing of your orders;
- Fica shall have no liability whatsoever in the event of incorrect or insufficient data being provided by the customer, which is necessary for the correct processing of orders;
- It is forbidden to send, introduce and/or transmit, or allow the sending, introduction and/or transmission, through Fica's website or social networks, of illegal or illicit content, computer viruses or any other technologically harmful or damaging software or material. You must not attempt to gain unauthorized access to this website, the server on which it is hosted, or any server, computer or database related to our website. The user undertakes not to attack this wesite via any denial-of-service attack or a distributed denial-of-service attack.
Any failure to comply with the provisions of this clause shall be considered an infringement under the terms defined by the applicable legislation. Fica will report any breach of this regulation to the corresponding authorities, and will cooperate with them to determine the identity of the attacker. Likewise, in the event of non-compliance with this clause, authorization to use this website will be immediately suspended.
Fica disclaims any liability for any damage or injury resulting from a denial-of-service attack, viruses or any other technologically harmful or damaging software or material that may affect the user's IT equipment, information or materials as a result of using this website, downloading content from it or from third-party websites to which the user is redirected by this website.

User Account

You may be required to create an account to access certain features of our Services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Our products and services (if applicable)

Our products are handmade in Lisbon, entirely or partially.

Our products are mostly handmade and are not mass-produced, so we cannot guarantee that they will be exactly as shown in the photographs. Some products are unique, one-off editions. They are handmade, exclusive and unique. We recommend that you consult the characteristics and details of the product you wish to purchase. Photographs may vary or be merely illustrative.

Due to the handmade production, imperfections and slight variations may occur in color, format and finish. These singularities accentuate the handcrafted process, making each piece unique. Embracing these variations is part of the artisanal process.

Product orders are subject to availability and all products have limited stock. Fica reserves the right to cancel an order if it is out of stock and undertakes to refund the customer.

The online store's product catalog may differ from the physical store's, both in terms of stock, price and products presented.

Fica reserves the right to change the product catalog, including prices and specifications. Although Fica keeps the information on the website up to date, whenever we process an order and we find an incorrect price, Fica must refund the difference if the price is lower than indicated. If the price is higher than indicated, Fica will contact the customer through one of the available contacts, to inform you and will await your decision to accept the new offer or cancel the order. 

Our screen printed tiles are envisioned as a work of art. They are fragile pieces and need to be handled with care.
Keep away from heat sources to prevent damages.
To preserve the quality of our ceramic products, clean them with a damp cloth only. Avoid the use of aggressive/abrasive detergents that could damage the surfaces of the ceramic.
Over time, a crazing pattern may develop.
Note that not every surface of the tile is coated with glaze. Some pieces are intentionally not completely glazed on the top surface for conceptual or aesthetic reasons.

Any service provided by FICA requires full payment in advance.

Prices and availability

It is in our interest to ensure that all prices, descriptions and details of a product are as clear and accurate as possible, however errors may occur. If we become aware of errors in the price of any merchandise, product or shipping charge, you will be informed of this and given the option to re-confirm the order at the correct price or cancel it. If we are unable to contact you, the order will be canceled. If payment has already been made, after canceling the order, we will give you a full refund.

Online ordering

The validation of the order presupposes that the user and customer accepts the Terms of Service of this website.

We cannot guarantee that all items listed on the website will be in stock when you place your order. If an item is unavailable, we will contact you shortly via phone or email. The website may contain typographical errors or inaccuracies. We reserve the right to update any information at any time without prior notice. These errors may pertain to product details, pricing, and availability. In such cases, we reserve the right to cancel any orders affected by pricing errors or inaccuracies. We apologize for any inconvenience this may cause.

Fica reserves the right to cancel any purchase even if it has already been accepted or confirmed by Fica, when:

- There is an error in the presentation of the item's price;
- There is incorrect information, namely on the date, time and price, in a scheduled training course, which compromises the other training courses;
- When the customer does not provide a shipping address;
- When the order is indicated as irregular or susceptible to fraud by the website's security systems;
- If you assume that the order comes from a reseller;
- In the event of a stockout. 

Payment

When you make a purchase through our website, you authorize us or our third-party payment processor to charge your payment method for the purchase amount, including any applicable taxes and additional charges. You are responsible for paying all fees on time and providing a valid payment method. All prices, fees, and applicable taxes and charges are payable in the currency you select at checkout. During the purchase process, you will be asked to provide standard billing information such as your name, billing address, and credit card details. Additional information may be required to verify your identity before completing the transaction. If you use a third-party payment processor, their terms and conditions will apply to your payment.

In accordance with current legislation, all items available on this website are subject to Value Added Tax (VAT). The price is marked with VAT included at the legal rate, excluding shipping costs.

The customer and user of this website has at their disposal several payment methods. Some of them are only available to customers of Portuguese banks (MBWAY and ATM Payment of Services).

Fica has the right to change product prices and shipping costs at any time, but without affecting completed orders.

Promotions

Promotion codes can be used only once per customer and cannot be combined with other offers unless specifically mentioned. These codes and offers are valid only within the specified time frame or while supplies last and do not apply to orders placed previously. We reserve the right to decline, suspend, or cancel promotional offers at any time.

Shipping

We aim to dispatch orders within the timeframe indicated at checkout. However, delivery times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control.

Newsletter

Fica cannot be held responsible for errors in sending the newsletter or for sending it directly to spam.
Fica has the right to remove from the subscriber list any e-mail account that reports hard/soft bounces or any error that jeopardizes the proper functioning of future newsletter mailings.

From time to time, there may be information on our site or within our Services that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. All the products sold on the website are in Portuguese legislation.

Fica cannot be held responsible for damage suffered by third parties resulting from the use of any of our products. Fica cannot be held liable for damage suffered by the Customer as a result of misuse of our products. 

Fica shall not be liable for any damages arising from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent users from accessing, browsing or the provision of services to users.

Indemnification

You agree to indemnify, defend, and hold harmless FICA, along with our officers, directors, agents, subsidiaries, joint ventures, and employees, from any claims, demands, as well as losses, expenses, damages and costs resulting from any violation of these Terms, your use of the Services, or any activity related to your Account.

Termination

We reserve the right to terminate your access to and use of the Services at our sole discretion, at any time, and without prior notice. You can disable access to your Account at any time by emailing us. Upon termination, discontinuation, or cancellation of the Services or your Account, the following sections will remain in effect: User Content, Payments, Feedback, Disclaimer of Warranty, Limitation of Liability, Dispute Resolution, Governing Law, and General Terms.

All content, products, and services on the site are provided to you "as is" without any guarantees or warranty. Without limiting the foregoing, we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of trade.

FICA, along with our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, and licensors, shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.
